Decree of Law 101D of December 7, 2020

With the entry into force of Decree Law 101-D of 7 December 2020, some changes in the legislation on the design, design and maintenance of buildings are foreseen.

 

With regard to the projects, the legislator finally clarified an issue that has always generated doubts and controversies. As of July 1st, the designers of the various specialties will be responsible for enforcing the regulation, with the PQ (Qualified Experts) having the task of verifying their compliance and issuing the Pre-Certificate and/or Energy Certificate.

 

Regarding technical systems, installation, replacement, updating and maintenance must be carried out by qualified technicians.

 

As for GES (Large Service Buildings), they must have a maintenance plan drawn up by a qualified technician and it must be submitted on the SCE portal. The maintenance record must be submitted annually on the SCE portal, by a qualified technician, as well as the building's energy consumption.

 

When there is a need to install, replace, or update a technical system, it will be mandatory to have an assessment of the overall energy performance of the system. In the special case of being a GES, the assessment will still have to be submitted on the SCE portal.

 

Regarding the technical systems installed in buildings (housing, services or businesses), they now have to have mandatory periodic inspections. ADENE, as the managing institution of the SCE, is preparing the technical manual provided for in the decree-law, and its publication is expected this year.
